BART TICKET GATE ACCIDENT: ALERT RE: ADULTS AND CHILDREN

Dear Claims Adjustor, ,

Would you please forward a copy of this email to _____, as I do not find
an email address for_____. I will call her office later this morning.

I contacted _____by telephone to ask questions and inform _____that
I am in the process of obtaining my medical records and choosing an attorney.
I have been advised by an attorney to not make a recorded statement or authorize
release of my medical records until I have retained a lawyer. That is my plan.

I acknowledge receipt of _____November 14, 2007 letter and forms.
I will not submit the forms at this time for reasons just stated.

I want BART Risk and Insurance Management, the Bart Board of Directors,
and John Glenn Adjusters to know thatI have posted a Blog about my accident for two reasons; I did so with the advise of a lawyer. I want to know who else has suffered injury from the impact of the Bart Ticket Gate, and I was informed by a BART employee that children get hit in the head! So, this is not just about fair compensation for my suffering, which continues through today, it is also to alert the public to a hazard. I was also told by a different Bart employee that they know about other adults being hit, and with just a few inquiries of friends and acquaintances, stories of others being hit were shared. www.BartTicketGateAccident.Blogspot.com.

I also posted the accident on a site called www.BartRage.com . What a fiasco!
There are those on that site, including the administrator, one moderator, and several posters who get their jollies from written abuse (cyberbullying). In my case, it was much greater than that.I discovered extreme racist remarks in many threads reaching back to 2005. I posted a request for their immediate removal. They did - I have hard copies of all the posts, the posts of mine they removed, and the discrimination against me. They have cleaned up a lot of it; one moderator has a level of integrity. The fact that they remained there for so long does not reflect well on that site. My life work is involved in human rights, animal welfare, environment, fair trade, street children, end to extreme poverty, etc. I recently stopped the latest incarnation of San Francisco KSFO Hate Talk Radio, KSFO. On that same site, Bart Rage, is the post of a woman who tripped on the stub of a sign in the BART parking lot - broke her knee in 3 places. She reported in subsequent posts that Bart had not yet rectified the danger. Red flag for more lawsuits!

Bart Ticket Gate Accident - LEGAL STUFF


Looking around the net for "BART ACCIDENTS" I came across the site www.BART Rage.com - A site to share both negative and positive BART experiences. I added this comment to a post from another BART patron who experienced a different
kind of accident:

Almost six months ago the BART automatic ticket gate (aka Fare Gate) slammed closed on my upper leg. EXCRUCIATING pain for about 30 seconds. Three weeks after the impact I am in the hospital with a hematoma. Bled twice extensively before becoming really enlarged,inflamed and infected in the last 2 months. - Acute Care, 2 overnight emergency ward stays, 6 acute surgery clinic visits, cat scan, sonagrams, MRI, biopsy, scheduled for surgery. Pain, fever, loss of work, mobility problems, possibility of blod clot breaking off and causing a stroke or heart attack. I shared the accident with only a few friends and acquaintances and found out about other adults being hit also by the ticket (fare) gate pinchers. I then asked two BART employees in different stations if they knew of others being slammed by the pinchers. I was told CHILDREN are hit in the HEAD! SO, my motivation is two fold. 1) Fair compensation. 2) To alert the public to the danger to adults and children.
LEGAL STUFF: One needs to file a claim with the BART Risk and Insurance Management Office before the 6 month statute of limitations. This is different than the incident report filed on the spot. I also recommend you at least do an initial consult with a lawyer so you are aware of your legal options. Personal injury lawyers charge a percentage which means there is no cash outlay. You can also represent yourself, and that sometimes means a larger settlement in your pocket. If you do not have a lawyer the BART process is that you will be contacted by BART Claim Administrators to make a recorded statement and for permission to look at your medical records. I would rather do this with a lawyer. How do I know all this? I started calling personal injury lawyers. Then I found some specializing in BART cases. BART informed me of the procedure about filing and the next step of the administrators. In an attorney consult (free) I was told I do not need to see the administrators without an attorney present; They will then automatically deny my claim, and I have six months to make a legal case. I also recommend you make enough calls to lawyers to find one who has compassion, integrity, and the expertise. It took me 10 calls to find someone like this. Bart Ticket Gate Accident


The BART Automatic Ticket/Fare Gate closed on my upper leg. Excruciating pain by the way. Hematoma, Complicated Inflamed/Infected Hematoma, MRI, CAT Scan, Sonagrams, two Overnite Emergency Ward Admits,and 5 Acute Surgery Clinics and six months later, I am left with the possibility of a blood clot breaking loose and and damaging my ticker, or a stroke that paves my way to the grave or a wheelchair - unless and until the mountain returns to a molehill and completely dissolves. Stress and worry.

SO! Two things.
One. I want a fair settlement for the suffering and pain, loss of income and opportunity to work. I want to pay my hospital bills. Two. JUST as important to me is that I want to put the word out about the danger of the ticket gate not only to adults, but to children who get hit in the head. With minimal inquiries to friends and acquaintances, came reports of other adults hit as well. The information about the children was shared by a BART employee.

BART needs to change the design/function of the gate that I have come to see as the pinchers of a malicious crab or losbster.
